Ferrari sued in the U.S. for alleged brake defects.

Ferrari is facing a lawsuit from some of its U.S. customers alleging that the company failed to address a brake problem that they claim could lead to a partial or total loss of braking function.

The proposed class action lawsuit is titled Nechev v. Ferrari North America Inc et al, U.S. District Court, Southern District of California, No. 3:13-cv-00401 (2012)

The main issue is that Bosch's parts The main problem is that brake fluid can leak from the brake fluid reservoir cap, which is a Bosch component, and this can lead to brake failure. Bosch is also a defendant.

Ferrari announced a recall in 2021 for the cap defect and voluntarily expanded the recall in 2022, but according to a proposed class action lawsuit filed this week in federal court in San Diego, the fixes involved in the recall are only interim measures and have not resolved other brake problems

The recall affected several Ferrari models dating back to the 2005 model year.

The proposed class action lawsuit is filed by California resident Ilya Nechev, who claims to have experienced brake problems with a 2010 Ferrari 458 Italia he purchased in 2020. According to Reuters, Nechev claims that he experienced brake problems several times and was told by the dealer that the experience was "normal" and that he would "get used to it."

In a statement to Reuters, Ferrari, without mentioning the proposed class action lawsuit, said that customer safety is its "top priority" and that its vehicles "always respect homologation specifications."
